OPPOSITION TEAMS UP AGAINST JAKAYA KIKWETE’S NOD TO BILL...

Dar es Salaam. In a rare show of unity, major opposition parties yesterday joined forces against the Constitutional Review (Amendment) Bill 2013, which Parliament passed earlier this month.

Chadema, CUF and NCCR-Mageuzi resolved to hold a joint campaign to persuade President Jakaya Kikwete not to sign the Bill into law following its endorsement by Parliament on September 6.

The chairmen of the three parties – Prof Ibrahim Lipumba (CUF), Mr Freeman Mbowe (Chadema) and Mr James Mbatia (NCCR-Mageuzi) – told a news conference in Dar es Salaam that they were against the President’s approval of the Bill before amendments are made to contentious clauses guiding the selection of Constituent Assembly members.

They said they would hold public rallies across the country from this weekend to drum up popular support for their opposition to the Bill, which gives the Union and Zanzibar presidents powers to appoint members of the Constituent Assembly.

The Opposition also wants the number of members of the assembly increased from 604 to 792 to check CCM’s domination.

They fear that the envisaged constitution would reflect the wishes of the ruling elite if CCM retains its majority in the assembly.

They also called for representation from Zanzibar to be increased to 50 per cent from the proposed 36 per cent.

Parliament passed the Bill in the absence of MPs from the three parties, who staged a walkout after failing to press for its withdrawal.

The endorsement was preceded by a stormy debate and ugly scenes, which saw some MPs scuffle with parliamentary security officials.

Opposition MPs had earlier said that stakeholders from Zanzibar were not fully involved in the collection of views on the Bill.

They also said some clauses in the final document tabled in Parliament were inserted without following proper procedures.

Reading a joint statement on behalf of his fellow party chairmen, Prof Lipumba said they would kick off their campaign on Saturday at Jangwani grounds in Dar es Salaam.

“The people have the right to hear how CCM is bulldozing others in the constitution-making process,” he said.

Prof Lipumba said President Kikwete would be making a “grave mistake” if he signs the Bill into law because the amendment and endorsement of the document by Parliament were against the spirit of his meetings with opposition leaders at State House in 2011 and early last year before the review process began in earnest.

“The President should return the Bill to Parliament so that changes meant to build trust and national consensus in the constitutional review process are made,” he said.

However, Prof Lipumba did not say what the parties would do if President Kikwete signs the Bill into law before they officially launch their campaign on Saturday.

Mr Mbatia said it was the opposition which initially pushed for the writing of a new constitution back in 1991.

“It is because of this fact that we are not ready to see our idea of writing a new constitution being played around with,” he said.

Mr Mbatia said political parties should put their differences aside and decide on what is best for the country.

“We request President Kikwete to put the national interest first, not the interests of his party,” he said. For his part, Mr Mbowe urged Tanzanians to stand up for an inclusive process of getting a new constitution.

“Peace will be at stake if the process towards a new constitution is dominated by a single political party...we want to avoid this,” said Mr Mbowe, who is also the Leader of the Official Opposition in Parliament.

He said the writing of a new constitution was a rare opportunity for the country to have a new beginning.

The opposition leaders spoke a few days after a cross-section of stakeholders appealed to President Kikwete not to assent to the Bill.

Opposition to the Bill shifted from Parliament to the public last week as key figures representing sections of society call for “presidential wisdom” in handling the matter.

The shift in language follows concerns among both legislators and the public about the process of preparing the legislation.

The move came barely a day after a forum in Dar es Salaam asked President Kikwete not to sign the new Bill into law, which gives the head of state authority to appoint 166 of the Constituent Assembly’s 604 members.

CCM legislators, however, were joined in the Chamber by special seats MP Clara Mwatuka (CUF) who chose to remain as well as the Maswa legislator, Mr John Magale Shibuda (Chadema) and Vunjo MP Augustine Mrema (TLP).

The Minister for Constitution and Legal Affairs, Mr Mathias Chikawe said despite the opposition walking out, they participated effectively during the preliminary stages of the Bill’s preparations.

Although the House finally passed the Bill with its various amendments, the Minister said he was saddened by the fact that the only problem with the opposition was that people of Zanzibar were not involved and consulted on the matter which was untrue.

He said the new proposed Act will now put a clear roadmap on how the constitutional assembly will be formed and how its membership and leadership will be.

“We were here to seek on how the constitutional assembly will be formed, among others, leading to the referendum process in November when we hope the Referendum Bill will be tabled,” he said.

Minister Chikawe wondered how the opposition including those from CUF in Zanzibar can deny being involved in the process, while the Zanzibar President and his two Vice- Presidents blessed the process and supported the Bill.

He said it would have been understood if the opposition were to boycott the Bill on other excuses but not by involving Zanzibar. He said the Bill has come with few new recommendations, mentioning section 21(1c) which explains how members of the Constitutional Assembly will determine and pass various resolutions.

Mr Chikawe said it was still undecided where the Constitutional Assembly will be held. “A venue for the Assembly will be established later as we need to secure a place where members will be able to concentrate to the maximum,” he said.

Earlier, the Deputy Minister, Ms Angela Kairuki said history will award President Jakaya Kikwete for initiating the new constitutionmove in 2010, adding that the president’s willingness to meet different stakeholders including the opposition parties and accommodate their proposals shows how committed he was to the agenda.

Meanwhile, some MPs sought clarification in the House demanding what action should be taken to Mr Joseph Mbilinyi for allegedly attacking a Police Officer shortly after he was forcibly removed from the Chamber on Thursday.

Mr Chistopher Ole Sendeka (Simanjiro – CCM) sought the attention of the Chairperson, Ms Jenista Mhagama on the matter saying the attack was a criminal act, lack of self-respect and clear abuse of the law to be shown by a law maker.

Mr Said Mkumba wanted the House to ask for the Second Vice -President of Zanzibar, Amb. Seif Ally Idd to comment on the opposition’s allegations that no single member from Zanzibar took part in the preparation of the amended Constitutional Bill.

Mr Idd confirmed that Zanzibar was fully involved in the process and he was the one who presented the views in writing. “Madam Chairperson, I confirm that what the Attorney General told the House was correct and I was the one who wrote the letter on Zanzibar’s position to be accommodated in the Bill,” he said.

On Mr Mbilinyi attacking the Security officer, Ms Mhagama said the Parliament needs to carefully study the matter before giving her comments, saying that it was the first time the Parliament had encountered such a scenario since its establishment.

The Tanzanian Ambassador to the United States, Ms Liberata Mulamula, told the ‘Daily News on Saturday’ in an exclusive interview that these proposals are in reaction to President Barack Obama’s speech when he visited Tanzania in July, this year.

“I have held talks with drone experts and they have helped clear the negative perception I had about them. I have received theproposals and the talks are ongoing,” she said.

On his visit to Tanzania in July, President Obama discussed the possibility of using unarmed, unmanned aircraft to help overstretched park rangers combat the growing problem of elephant poaching in the country’s vast wildlife reserves andnational parks.

Amb. Mulamula said that the speech by President Obama had generated a lot of interest among American conservationists and that they are ready to continue the global campaign against wildlife poaching.

The White House announced that up to 10 million US Dollars in new financial support has been set aside to help tackle poaching for ivory and rhino horn.

This funding includes approximately three million US Dollars in bilateral assistance to South Africa, three million US Dollarsin bilateral assistance to Kenya and four million US Dollars in regional assistance throughout sub-Saharan Africa.

According to a report in the Global Travel Industry News, a global organisation, Monitoring the Illegal Killing of Elephants (MIKE), an estimated 17,000 elephants were illegally killed in 2011 – a figure likely to be over 25,000 in the continent.

For many of the range states in Central and Western Africa, the extent of the killings now far exceeds the natural population growth rates, forcing their elephants into widespread decline and putting them at risk of extinction in those countries.

The total African elephant populations remain stable owing to effective protection in parts of Southern and Eastern Africa, where there is the majority of the elephant population. Rhino poaching is rampant in Tanzania, but, most of these animals have disappeared, while few remained in highly-protected parks.

About three years ago, wildlife conservationists blamed Tanzania after one of 5 Eastern Black Rhinos from South Africa was gunned down inside the Serengeti National Park.

Amb. Mulamula said that in the one month that she had taken office as the new Tanzanian Ambassador to the United States, she has seen for herself the level of interest among Americans to partner and invest with Tanzania.

These interests include ‘Kilimo Kwanza’ and health where towards the end of the month, ten top notch journalists will be visiting the country on a fact finding mission, while journalists under the Bill & Melinda Gates Foundation sponsorship will be coming.

“When the John Hopkins University advertised for the opportunity to visit Tanzania, they had ten slots but believe it or not, over 400 applications were received. It goes without saying that Tanzania is under the spotlight and we will do all we can to positively stay there,” she said.

Ms Mulamula said that it was unfortunate that many Tanzanians have the notion that foreign investors are coming to rip us off, but stressed that without properly using the private sector and our friends, it was next to impossible to meet and achieve out intended goals.

She said it was high time that Tanzanians who have been sitting on potential wealth for too long woke up from slumber and start playing their part in the development of the nation. “We now have the structures, the frameworks, priorities and policies.

The US has everything and so people have to do away with this notion that foreigners are coming to steal from us.

However, if we continue to sleep like it was the case of the royalties in the mining sector, it is possible we will lose more than we gain, a lot of times we are the causes of our problems,” she said.

TANZANIA PRIME MINISTER Hon.MIZENGO PINDA PRAISES INNOVATIVE YOUTH GROUPS.....

Announcing the decision in Dodoma, Prime Minister, Mr Mizengo Pinda told the Parliament that government is encouraged byinitiatives shown by various youth groups and graduates and encourages more young people to emulate them.

The premier made the statement as he adjournment of the 12th Parliamentary meeting which will resume at the end of nextmonth in Dodoma.

Mr Pinda challenged communities to extend cooperation and assistance to youth who opt for self-employment and urged experts to assist them.

He listed a number of youths groups in Tabora Region and the Sokoine University Graduates Entrepreneurs (SUGECO), as groups that are doing a great job in various projects including agricultural ones.

“I urge all Tanzanians to support these groups,” he said and added that elders should insist on ethics and integrity.

On the war against drugs trafficking, the premier said Tanzania still faces a challenge as drug trafficking cases take longer in the courts, for example, out of 368 of such cases filed in court between 2010 and July, this year, only 91 have been ruled and 245 are still in court.

However, he said the war is a tough one and it was crucial to encourage those in the frontline against drugs trafficking and when possible promote and reward officers sacrificing their lives to keep Tanzania free of drugs.

On the various development programmes in the country, Mr Pinda said the programmes are accelerating well despite a few challenges and said the country’s Big Results Now (BRN) initiativeis set to succeed.

Commenting on the water sector, the premier said government is working on the establishment of the National Water Investment Fund.

“We have already set aside about 100m/- as seed money ahead of the Fund’s establishment and the Ministry of Water will review the Water Act in order to broaden sources of income for the Fund,” he said.

He asserted that the opposition camp in Parliament should learn to conduct themselves in a civilized manner and stop the culture of boycotting Parliament sessions.
